Keadaan ini menyebabkan banyak premis haram diubahsuai menjadi gua
tiruan untuk habitat burung itu, selain mewujudkan masalah bunyi
bising akibat sistem audio frekuensi tinggi yang digunakan pengusaha
untuk memanggil burung itu.
Zulkifli berkata, MPT sudah mengeluarkan 10 saman kepada premis yang
diubahsuai secara haram berdasarkan aduan orang ramai berikutan
terdapat gangguan bunyi bising sehingga mengganggu ketenteraman awam.
"Sebenarnya, burung walit bukan jenis yang pengotor kerana najisnya
hanya ada dalam bangunan dan ini berbeza dengan burung layang-layang
yang membuang najis di merata tempat sehingga mengotorkan pekan

TEMERLOH: Majlis Perbandaran Temerloh (MPT) menerima 320 permohonan
untuk menjalankan kegiatan menternak burung walit di sekitar bandar
itu termasuk Mentakab, tetapi masih belum mengeluarkan sebarang
kelulusan setakat ini.
Jumlah permohonan yang tinggi bagi sesebuah pekan kecil seperti
Mentakab itu, jelas menunjukkan aktiviti itu mula mendapat perhatian
penduduk berikutan populasi burung walit yang semakin bertambah di
situ.
Bagaimanapun, MPT tidak sewenang-wenangnya mengeluarkan lesen kegiatan
itu, sebaliknya perlu mengambil kira pelbagai faktor persekitaran dan
kesan sampingannya, berikutan ia membabitkan premis di kawasan
bandar.
Yang Dipertua MPT, Datuk Zulkifli Yaacob, berkata pihaknya terpaksa
menggantung sementara semua kelulusan untuk 320 permohonan itu kerana
perlu merujuk kepada garis panduan baru bagi penternakan burung walit
yang akan dikeluarkan Kementerian Perumahan dan Kerajaan Tempatan
tidak lama lagi.
"Setakat ini hanya tiga pengusaha saja diberikan lesen oleh MPT
berdasarkan kepada garis panduan lama.
"Dua pengusaha beroperasi di premis perniagaan di pekan Mentakab,

Sarawak: LICENSING OF TRADE, IMPORT AND EXPORT OF EDIBLE BIRDS’ NESTS

INTRODUCTION
The trade of the edible birds’ nests in Sarawak includes collecting, selling, buying, importing and exporting, and has contributed to government revenue in the State. Under the Wild Life Protection Ordinance 1998 and its subsidiary legislation the Wild Life Protection (Edible Birds’ Nest) Rules 1998, all swiftlets are legally protected in Sarawak. Thus, all collection, selling, buying, imports and exports of birds’ nests requires a licence. Implementation of these laws falls under the jurisdiction of the Forest Department. Two other Government agencies are also involved, namely the Agriculture and Customs Departments.
The Forest Department issues licences for collecting, trading, exporting and importing of edible birds’ nests. Collecting and trading licences cost RM100 per year. Licences to import and export processed birds’ nests cost RM50 per kg, and those to import unprocessed birds’ nests are RM2 per kg.
The function of the Agriculture Department is to issue a health certificate in accordance with Section 9 (1) of the Public Health Ordinance 1999. The fee is RM10 per consignment (Mdm Ranie, personal communication).
The Customs Department imposes a 5% sales tax on the total quantity of birds’ nests imported or exported. All imports and exports of birds’ nests must be declared to this department (Joseph Melayu, personal communication).
The aim of this study was to compile and compare the records of the different types of licences related to the birds’ nest trade as issued by the different government agencies. This was to assess how accurate were the licensing and enforcement procedures of the different agencies, and to determine whether the maximum revenue was therefore being collected.
COLLECTING AND TRADING LICENCES
In June 2001, 181 collecting licences and 164 trading licences had been issued by the Forest Department. This was a decline of 32 licences from 1999 (Table 1).

The records for imports of edible birds’ nests by the different government departments varied greatly from each other. In 1998, the Agriculture Department record of 5,180 kg of birds’ nests was 79% higher than that of the Forest Department. Conversely, the Customs Department recorded 1,811kg less than the Forest Department. In 1999, both the Agriculture and Customs Departments recorded more birds’ nest imports than did the Forest Department, although even their figures differed greatly from each other: the Agriculture Department recorded 10,941kg and Customs Department 2,928kg, or 131% and 36% more than the Forest Department respectively. In 2000, again both the Agriculture Customs Departments’ records were higher than the Forest Department, with the former recording 3,894kg or 25% more, and the latter recorded 4,873 kg or 31% more (Table 2 and Figure 1).

EXPORT OF EDIBLE BIRDS’ NESTS FROM SARAWAK
The recorded exports of birds’ nests by the Customs Department from 1998 to 2000 were always higher than those of the Forest Department. In 1998, Customs recorded 7,391kg or 578% higher; in 1999, 8,504 kg or 810% higher, and in 2000, 8,456 kg or 514% higher (Table 3 and Figure 2). Thus, from 1998 to 2000, the Forest Department has lost an average of RM405,850 from the average of 8,117kg of birds’ nests exported illegally without a licence issued under the Wild Life Protection Ordinance.

DISCUSSION
The study shows there was a decrease in the number of birds’ nest trading licences issued, from 196 in 1999, to 164 by June 2001.
The figures on the imports and exports of birds’ nests as recorded by the three relevant government agencies were very different. The figures suggested that huge quantities of birds’ nests were exported or imported with licences from the Agriculture and Customs Departments, but with no proper legal documents from the Forest Department.
CONCLUSION
Lack of proper monitoring systems by the Forest Department for both imports and exports of birds’ nests could be the main factors that might have led to the illegal trading of birds’ nests to and from Sarawak. Moreover, both the Agriculture and Customs Departments seldom refer to the Forest Department regarding the procedures for trading birds’ nests.
All three government agencies involved should sit down together to discuss all matters pertaining to procedures on the import and export of birds’ nests. This would help to avoid any confusion or misunderstanding on procedures or policy matters pertaining to the trade of the nests. The Agriculture and Customs Departments should always keep in touch with the Forest Department whenever they encounter any problems relating to the trade of birds’ nests.

Penang: Local Council Guidelines on Birdnest Farming

Title : Penang Gov Implemented swiftlet Farming Guidelines, violators license will be revoked.
From Jan 1st , Penang Gov . officially implements swiftlet farming guidelines, farmers shall complies to all the local gov./council's requirement prior to operation, the said guidelines also contains guidelines for the farm house and other licensing requirements. Violators will not have the license renewed, and will be punish under the relevant guidelines.
These licenses are for the period of one years from Jan 1st to Dec 31st.
The require license are:
1) Nest collection license RM 200
2) Wildlife commercial license RM150
3) Wildlife import/export license RM100 every kilogram
4) Farm building's commercial license with local council
Under the guidelines, farm building must not be more then 18 meter in height, encourage to be painted rice-white color externally.

Owner also need to ensure the farm's cleanliness so not lead to , foul smell, flies, mosquito or disease.
Other then ensuring farm cleanliness, owner also need to ensure the overall looks/fells (cosmetically I think )of the building, rice-white color for external are encourage for ease of identification.
Farm located on agriculture land needs to apply for land usage conversion from the relevant authority.
Guidelines also stipulates that residential areas are not allow for farming purpose, historical building publicly declares as Warisan Heritage too are prohibited from farming usage.
No ground floor should be used for farming unless with consent from local Gov., special consideration given to those building that has been left empty for a period of time.
Farm house should not be more then 18 meter in height ( approximately 5 storeys), during renovation, any structural change will require engineering consultant's approval for structural integrity.
Local Gov/council 's approval on drawing are needed for any extension/expansion of existing farm building.
Under the guidelines, bird calling sound broadcasting must be between 7am to 7pm, volume not exceeding 40 db, speaker must be pointing at least 60 degrees skyward, and 6 meters away from walls.
Farm house must maintain cleanliness , must have a rubbish bin with covers that is large enough to cater for the needs of the farm , all rubbish can be loaded in to plastic bag before put into rubbish bin and dispose off later.
A light must be install at the external of the farm . Owner must install modern devices to control the humidity and temperature of the farm, no water pool/pond/ water tank inside the farm , no stagnant water on the floor.
Other requirements includes :
1)Floor and lower part of the wall must be water proof to prevent seeping through of contaminants.
2) Owner must comply with all local gov./council/dept's guidelines.
3) Owner must renew their license every years, the authority has the right not to renew license.
The authority can bring to court violators under the following act/law/ regulations 1976 City /Town planning act ,section 27, 1974 Road/drainage & building act , section 70(1), (12) & (13) 1974 Road/drainage & building act, section 79 1974 Road/drainage & building act, section 84 1975 Extermination of disease born insects act 1972 Wild life protection act (76)

Kerajaan hari ini memutuskan untuk membenarkan orang ramai menternak burung walit dan mengiktiraf bidang itu sebagai perusahaan yang berpotensi tinggi untuk menghasilkan pulangan yang lumayan.
Timbalan Perdana Menteri Datuk Seri Najib Tun Razak berkata keputusan itu dicapai pada mesyuarat Majlis Negara Mengenai Kerajaan Tempatan kali ke-53 yang dipengerusikannya di sini.Penternak burung bagaimanapun perlu mematuhi beberapa syarat yang ditetapkan oleh Pihak Berkuasa Tempatan (PBT) sebelum kelulusan dikeluarkan bagi menternak burung itu, katanya kepada pemberita selepas mesyuarat itu.
Antara peraturan itu ialah aktiviti ternakan itu tidak dibenarkan dijalankan di dalam atau berhampiran kawasan perumahan dan penghasilan bunyi untuk memanggil burung berkenaan hendaklah dibuat pada tahap nada bunyi yang rendah.
Burung walit kini banyak diternak di Pantai Barat Semenanjung. Perak ialah antara negeri yang didapati banyak menjalankan aktiviti ternakan burung itu berikutan berlakunya migrasi secara besar-besaran burung itu dari Medan, Indonesia.

Timbalan Perdana Menteri Datuk Seri Najib Tun Razak berkata keputusan itu dicapai pada mesyuarat Majlis Negara Mengenai Kerajaan Tempatan kali ke-53 yang dipengerusikannya di sini.Penternak burung bagaimanapun perlu mematuhi beberapa syarat yang ditetapkan oleh Pihak Berkuasa Tempatan (PBT) sebelum kelulusan dikeluarkan bagi menternak burung itu, katanya kepada pemberita selepas mesyuarat itu.
Antara peraturan itu ialah aktiviti ternakan itu tidak dibenarkan dijalankan di dalam atau berhampiran kawasan perumahan dan penghasilan bunyi untuk memanggil burung berkenaan hendaklah dibuat pada tahap nada bunyi yang rendah.
Burung walit kini banyak diternak di Pantai Barat Semenanjung. Perak ialah antara negeri yang didapati banyak menjalankan aktiviti ternakan burung itu berikutan berlakunya migrasi secara besar-besaran burung itu dari Medan, Indonesia.

PEMELIHARAAN burung walit (swiftlet) oleh pengusaha sarang burung perlu menepati ciri-ciri dan peraturan yang ditetapkan supaya industri itu tidak mendatangkan gangguan kepada masyarakat setempat.
Timbalan Menteri Pertanian Industri dan Asas Tani, Datuk Seri Shariff Omar, berkata beberapa kriteria sudah ditetapkan kerajaan berhubung isu pemeliharaan burung berkenaan antaranya mengehadkan kadar bunyi dan kawasan peliharaan yang bersesuaian.
"Rundingan dengan Kementerian Perumahan dan Kerajaan Tempatan juga sudah dibuat, antaranya pemeliharaan perlu dibuat di kawasan perumahan yang terbengkalai supaya ia tidak mengganggu ketenteraman orang ramai selain menjamin kebersihan.
"Burung layang-layang mempunyai dua jenis spesies iaitu walit dan layang-layang, kedua-dua burung ini tidak mempunyai sifat sama," katanya menjawab soalan tambahan Abdul Fatah Harun (BN-Rantau Panjang).
Katanya, gangguan bunyi daripada pengusaha sarang burung walit sentiasa dipantau supaya tidak melebihi kadar 45 desibel (dsb) pada waktu malam dan 55 dsb untuk siang selaras dengan ketetapan Pertubuhan Kesihatan Sedunia (WHO).

Aktiviti menternak burung walit untuk diambil sarangnya akan ditumpukan ke kawasan luar bandar bagi memudahkan kerja pemantauan.
Pengerusi Jawatankuasa Pertanian, Industri Asas Tani, Kemajuan Luar Bandar dan Wilayah, Ahmad Zahri Jamil berkata pengalihan tumpuan dari kawasan bandar juga adalah bagi memastikan aktiviti itu membangun dengan lebih tersusun.
Katanya menternak burung walit untuk sarangnya merupakan satu aktiviti ekonomi yang amat menguntungkan dan berdaya maju tinggi.
“Aktiviti ini membangunan dengan pantas dan sehingga kini, terdapat 208 premis yang tidak berpenghuni telah diubah suai menjadi rumah burung walit yang diusahakan 204 orang.
“Sebagai langkah memastikan ia membangun dengan lebih tersusun, Kerajaan akan hanya menggalakkan aktiviti ini di luar kawasan majlis daerah sahaja,” katanya menjawab pertanyaan ahli Dewan Negeri kawasan Pemanis, Lau Chin Hoon mengenai perkembangan aktiviti itu.
Ahmad Zahri berkata lesen hanya akan diberi kepada pengusaha yang telah membuktikan keupayaan mereka serta mampu mencadangkan kawasan yang mempunyai populasi burung walit yang tinggi.
Beliau berkata setakat ini, pembabitan Kerajaan Negeri dalam aktiviti ini adalah minima dan kesemua projek sedia ada diusahakan samada secara individu atau syarikat swasta.
Burung walit atau nama saintifiknya aerodramus fuciphagus adalah sejenis burung dari spesis burung layang-layang yang berasal dari kawasan hutan rimba dan gua batu di Asia Selatan, kepulauan di selatan Lautan Pasifik dan kawasan timur laut Australia.
Berbanding burung layang-layang yang membuat sarang menggunakan daun, ranting halus dan batu kecil, burung walit menggunakan air liurnya untuk membuat sarang.
Menurut masyarakat Cina, sarang burung walit memiliki khasiat tersendiri dan mempunyai permintaan yang tinggi dalam pasaran menyebabkan harganya boleh mencecah sehingga RM25,000 sekilogram.
Menjawab soalan tambahan wakil rakyat Yong Peng, Lim Kee Moi mengenai kemungkinan burung ini membawa virus selsema burung, Ahmad Zahri berkata setakat ini perkara itu belum dibuktikan lagi.

Guidelines on swiflet nest farming issued
PUTRAJAYA:
Swiftlet nests, reportedly reaping RM1.5mil a month, will not be allowed to be cultivated in housing as well as in public and recreational areas under guidelines issued by the Government yesterday.
The guidelines, however, are only applicable to birdhouse operators in the peninsula.
“Sabah and Sarawak have their own state provisions governing the industry and their bird nests are harvested from the wild,” said Science, Technology and Environment Minister Datuk Seri Law Hieng Ding.
Birdhouses must only be built on agricultural land or in light industrial areas and the use of loudspeakers to lure the birds is also prohibited, according to the new Guidelines on Swiftlets’ Nest Industry.
Law said the guidelines was to ensure the farming and collection of edible swiftlets’ nests from buildings do not become a nuisance and a health hazard.
“It is also to ensure that the collection and farming do not jeopardise or reduce the species’ population,’” he told reporters after launching the guidelines at his office here.
Law said the guidelines were, however, voluntary in nature. But the authorities could still act against errant operators because the swiftlets, of the white nest and black nest species, were protected under the Wildlife Protection Act.
“The industry is also subjected to the Uniform Building Bylaws 1986, the Destruction of Disease Bearing Insects Act 1975 and Health Department regulations.
“Birdhouse operators must get premise licence from their local authorities, a collection of birds nest license and a trading of birds nest license from the Department of Wildlife and National Parks,” he said.
Malaysia Bird’s Nests Merchants Association president John Chen said: ”Our production is around 200kg to 300kg per month.”

Guidelines drawn up to regulate swiftlet farming

Sarawak has drawn up guidelines for commercial swiftlet farming, which is gaining popularity in the state.
Environment and Public Health Minister Datuk William Mawan Ikom said the authorities had to ensure that this new industry was regulated to minimise negative health and environment impacts.
He said under health control measures drawn up, swiftlet farming structures must be sited on agriculture land and not be located in populated or recreational areas.
Other guidelines state that bird droppings must be removed regularly; sewage from the washing and cleaning process of a swiftlet house must be channelled into septic or sedimentation tanks; and effluents should not be discharged directly into natural waterways.
Mawan also said a licence from the controller of wildlife must be obtained before any swiftlet farm could be set up.
“The state Veterinary Authority will have to certify that the birds’ nests from these farms are fit for consumption before they are sold or exported to foreign markets,” he told Daniel Ngieng (BN–Bukit Assek) during question time.
State Tourism Minister Datuk Abang Johari Tun Openg informed the house that the government planned to gazette the legendary Gunung Santubong as a protected area.
There are already trails and walkways leading to the summit of Gunung Santubong, which covers 2,655ha of pristine forest, where visitors could enjoy the scenic beauty of the city and South China Sea.
Johari said the proposal to build a cable car system there would have to be studied.
